Civil Procedure for Public Service Exams

This course is for Brazilian public service exams (concursos públicos) and the lessons are taught in Portuguese. The Brazilian Code of Civil Procedure, Law 13.105 of 2015, appears in the exam notices for court clerk and court analyst positions at the state courts, the federal regional courts, the labor courts and the superior courts, and exam boards test the exact wording of the code, swapping a deadline, a party or a consequence. This course starts from zero and explains the code with Prof. Daniel, always using the text in force. Part one is the fundamental rules: the court acts only when asked, the right to be heard, no surprise decisions, good faith, cooperation, plus jurisdiction and the right of action. Part two is jurisdiction of the courts: limits of Brazilian jurisdiction, the domicile of the defendant, special venues, absolute and relative competence, related cases, forum selection clauses and how to object. Part three is the parties: capacity, duties, bad-faith litigation, legal aid, lawyers, joinder, third-party intervention, the powers of the judge, disqualification, the Public Prosecution Service, government attorneys and the Public Defender Service. Part four is procedural acts: form, time and place, deadlines counted in business days, service of process, notices, nullities and the value of the claim. The last part is the ordinary procedure: provisional relief, the complaint, early dismissal, the conciliation hearing, the defense, counterclaim, default, case management, burden of proof, judgment and res judicata. The questions follow the exam-board style, with True or False and multiple choice, and every answer cites the deciding article.
