Administrative Law for Public Service Exams
This course is for Brazilian public service exams (concursos públicos) and the lessons are taught in Portuguese. Administrative Law appears in almost every Brazilian civil service exam, and many questions are solved by reading the statute carefully. The course starts from zero with Professor Daniel and follows the law currently in force, always citing the article behind each answer. Part one is principles and administrative organization: the principles in article 37 of the Brazilian Constitution and in Law 9,784/1999, direct and indirect administration, bodies and entities, autarchies, public foundations, state-owned companies and mixed-capital companies. Part two is administrative acts: elements, attributes, bound and discretionary acts, statement of reasons, annulment, revocation and validation. Part three is the federal administrative procedure of Law 9,784/1999: delegation and avocation, impediment and suspicion, deadlines, the duty to decide and appeals. Part four is administrative improbity after Law 14,230/2021: intent as a requirement, the three types in articles 9, 10 and 11, the penalties in article 12 and the limitation period. The last part is public procurement and contracts under Law 14,133/2021: bidding modalities, award criteria, waiver and non-requirement of bidding, changes to and termination of contracts, and penalties. Questions follow the style of the Cebraspe, FGV and FCC exam boards, with True or False and multiple choice, and every answer gives its legal basis.
